Article 1 To further regulate the municipal engineering market order, improve the integrity system of municipal enterprises, strengthen the joint supervision of market behaviors of all construction parties and on-site construction behaviors, and create an honest and trustworthy construction environment. These rules are formulated in accordance with the "Construction Law," "Tendering and Bidding Law," "Regulations on Quality Management of Construction Projects," "Regulations on Safety Production Management of Construction Projects," and other relevant laws and regulations, as well as the Ministry of Housing and Urban-Rural Development's "Measures for the Management of Integrity Behavior Information in the Construction Market" (Jianshi [2007] No. 9) and other related documents.

Notice on the Implementation of the "Implementation Rules for the Credit Assessment of Municipal Enterprises in Changzhou (Trial)"

Chapter 1 General Provisions
Article 1 To further regulate the municipal engineering market order, improve the integrity system of municipal enterprises, strengthen the joint supervision of market behavior of all parties involved in construction and on-site behavior, and create an honest and trustworthy construction environment. This rule is formulated in accordance with the "Construction Law", "Tendering and Bidding Law", "Regulations on Construction Project Quality Management", "Regulations on Construction Project Safety Production Management", and other relevant laws and regulations, as well as the Ministry of Housing and Urban-Rural Development's "Measures for the Management of Integrity Behavior Information in the Construction Market" (Jianshi [2007] No. 9) and other documents.
Article 2 The credit assessment of municipal enterprises referred to in these rules is a quantitative scoring of the credit status of construction enterprises with municipal public construction general contracting qualifications (hereinafter referred to as municipal enterprises). During the assessment period, based on national laws, regulations, current standards, and norms, the market behavior of enterprises (project contracting, social and industry rewards and punishments, bidding activities, contract performance, etc.) and on-site behavior (including quality behavior, safety behavior, management of migrant workers, etc.) are quantified to obtain the municipal credit assessment score.
Article 3 The credit assessment of municipal enterprises adheres to the principles of legality, openness, fairness, justice, and honesty. It is market credit construction-led, government supervision-based, project-based, and operates under the mode of "government promotion, authoritative release, information sharing, unified standards, reasonable rewards and punishments, and social supervision."
Article 4 The Changzhou Urban and Rural Construction Bureau is responsible for the management of the credit assessment of relevant municipal enterprises. The Urban Construction Division of the bureau (hereinafter referred to as the "Urban Construction Division") is specifically responsible for collecting, verifying, entering, and publishing credit assessment information of municipal enterprises. The Municipal Construction Management Center, bidding supervision, administrative law enforcement, municipal project construction, and other units entrusted by the Urban and Rural Construction Bureau are the credit assessment information entry units.
Article 5 The electronic management platform for the credit assessment of municipal enterprises is the "Changzhou Construction Market Supervision and Management Information System"; the paper management platform for municipal enterprise credit management is the "Jiangsu Province Construction Industry Enterprise Credit Management Manual."
Municipal enterprises apply for an enterprise encryption lock with their corporate business license and organization code certificate, log in to the "Changzhou Construction Market Supervision and Management Information System," enter basic enterprise information, and establish a municipal enterprise credit file.
Chapter 2 Assessment Content and Scoring Methods
Article 6 The municipal enterprise credit assessment score consists of three parts: basic credit, comprehensive assessment, and daily assessment.
Article 7 Basic credit is a quantitative assessment based on the enterprise's basic information and rewards during the assessment period, with a full score of 30 points.
The "Basic Credit Assessment Content and Scoring Method for Municipal Enterprises" is detailed in Attachment 1.1.
Article 8 The comprehensive assessment is a periodic comprehensive inspection of municipal projects organized by construction units within our bureau's system, quantitatively assessing municipal enterprises' market behavior, on-site behavior, and actual quality, safety production, and civilized construction status, with a full score of 70 points.
The "Comprehensive Assessment Content and Scoring Method for Municipal Enterprises" is detailed in Attachment 1.2.
Article 9 The daily assessment refers to quantitative deductions for adverse behaviors of municipal enterprises during construction activities, with no upper limit on daily assessment deductions.
The "Daily Assessment Content and Scoring Method for Municipal Enterprises" is detailed in Attachment 1.3.
Chapter 3 Assessment Entry and Result Publication
Article 10 Relevant information on the basic credit of municipal enterprises shall be entered by each enterprise into the "Changzhou Construction Market Supervision and Management Information System" by themselves, including basic information and rewards, and kept updated in a timely manner. At the same time, relevant supporting materials shall be provided to the Urban Construction Division for verification.
Article 11 Credit information entry units shall establish and improve daily supervision and management, various inspection, patrol, and spot-check systems according to their management responsibilities, improve credit assessment content and scoring methods, and enter various assessment information timely and accurately.
Article 12 The Urban Construction Division shall propose the municipal enterprise credit assessment score for the assessment period based on the enterprise's basic credit information, comprehensive assessment information, and daily credit information, and publish the results.
Article 13 The results of the municipal enterprise credit assessment shall be published twice a year (end of June and end of December). Credit information collection shall stop two working days before the publication of the credit assessment results; new information will be transferred to the next assessment period. The municipal enterprise credit assessment is valid from the date of publication until the day before the next publication and shall be recorded in the municipal enterprise credit file.
Newly established local and out-of-town municipal enterprises participating in construction bidding for the first time in Changzhou shall use the initial credit score determined in the city supervision information system as the standard.
Article 14 The basic credit assessment score of municipal enterprises is calculated according to Attachment 1.1.
Municipal enterprises that do not participate in the comprehensive assessment shall have their comprehensive assessment score calculated as the average score of all municipal enterprises participating in the comprehensive assessment during the assessment period.
For municipal enterprises with missing quality, safety, or progress scores in the comprehensive assessment, the missing category comprehensive assessment score shall be calculated as the average score of the corresponding category comprehensive assessment scores of all municipal enterprises participating in the comprehensive assessment during the assessment period.
Enterprises with other construction qualifications in the construction industry shall have their municipal credit assessment scores listed separately in the evaluation system.
Chapter 4 Application of Results
Article 15 After confirmation and generation of the municipal enterprise credit assessment results in Changzhou, participating municipal enterprises can log in to the system using the encryption lock to inquire.
Article 16 The municipal credit assessment scores are applied to municipal project construction bidding organized by construction units within our bureau's system; other projects may refer to this for implementation.
Chapter 5 Supervision and Management
Article 17 The entry of municipal enterprise credit information shall ensure the authenticity and completeness of the credit information.
Article 18 Credit assessment information entry units shall strengthen the collection of daily assessment information of municipal enterprises, ensure comprehensive information collection, accurate behavior classification, timely supervision and inspection, and guide municipal enterprises to operate legally and with integrity. See Attachment 1.4 for details.
Article 19 If credit information collectors violate laws, regulations, rules, or these measures, municipal enterprises may complain or report to the Urban and Rural Construction Bureau.
Chapter 6 Supplementary Provisions
Article 20 These rules are interpreted by the Urban and Rural Construction Bureau.

Basic Credit Assessment Content and Scoring Method for Municipal Enterprises
 
1. Municipal enterprises with valid "Qualification Certificate" and "Safety Production Permit" will receive a basic enterprise score of 14 points.
 
2. Scores will be given based on the following conditions according to specific situations.
 
(1) Project Contracting Scores. For municipal enterprises registered in the "Jiangsu Province Construction Enterprise Credit Management Manual," each municipal engineering project contracted within our city's administrative area with a contract price of 10 million yuan (inclusive) or more, as recorded by the bidding department, will receive 1 point; for contract prices below 10 million yuan, each will receive 0.5 points; no projects will result in zero points, with a maximum of 6 points. Valid for 36 months.
 
(2) Scores for Commendations and Other Types of Notifications and Awards for Contracted Municipal Projects. For the same enterprise, the same project, and the same type of honor at different levels, only the highest level score will be counted without accumulation. There is no limit to the number of projects for each level of honor, with a maximum cumulative score of 10 points for all levels. The time is based on the issuance date of the commendation document.
 
1. Each municipal project awarded the Luban Award, National Quality Project, or Golden Cup Award will receive 3 points, valid for 36 months.
 
2. Each municipal project awarded the provincial-level quality demonstration project (including the "Yangtze Cup" Award) will receive 2 points, valid for 24 months.
 
3. Each municipal project awarded the Changzhou City quality demonstration project (including the "Golden Dragon Cup" Award) will receive 1 point, valid for 12 months.
 
4. Each municipal project awarded the provincial-level civilized construction site title or standardized demonstration site will receive 2 points, valid for 24 months.
 
5. Each municipal project awarded the Changzhou city-level civilized construction site title will receive 1 point, valid for 12 months.
 
6. Each municipal project awarded the Changzhou city or district civilized construction site title will receive 0.5 points, valid for 12 months.

Comprehensive Assessment Content and Scoring Method for Municipal Enterprises
 
1. The comprehensive assessment of municipal enterprises refers to the quantitative evaluation conducted by the comprehensive inspection team on the market behavior, project management, quality behavior, safety behavior, physical quality, and safety production status of construction units organizing municipal projects within the bureau system. The comprehensive inspection team consists of relevant departments of the bureau, the Municipal Construction Management Center, and personnel from the project construction units.
 
2. The comprehensive inspection team scores according to the requirements of the "Changzhou Municipal Public Works Construction Quality Assessment Rules (Trial)" (Attachment 1.2.1), and the score multiplied by 25% is used as the comprehensive assessment score of the enterprise's credit score.
 
3. The comprehensive inspection team scores according to the "Changzhou Municipal Infrastructure Project Safety Production and Civilized Construction Assessment Rules" (Changjian [2006] No. 177) and the "Notice on Amendments to the " (Changjian [2014] No. 176), and the score multiplied by 25% is used as the comprehensive assessment score of the enterprise's credit score.
 
4. The comprehensive inspection team scores the on-site progress according to project target requirements, and the score multiplied by 20% is used as the comprehensive assessment score of the enterprise's credit score.

Changzhou Municipal Public Works Construction Quality Assessment Rules (Trial)
 
Article 1: To further improve the assessment system for municipal engineering construction, enhance construction quality management levels, and combine with actual projects, these assessment rules are formulated.
 
Article 2: These rules apply to municipal public projects organized by construction units within the bureau system.
 
Article 3: The construction quality assessment of municipal projects is organized and implemented by the comprehensive inspection team.
 
Article 4: Routine assessments are generally organized once every two months. The comprehensive inspection team assesses ongoing projects. The assessment standards are detailed in the "Municipal Engineering Quality Assessment Form" (Form 1). The assessment results are calculated on a 100-point scale, and actual assessment items scoring less than 100 points are proportionally converted to a 100-point scale.
 
Attachment 1.3
Daily Assessment Content and Scoring Method for Municipal Enterprises
1. Scores will be deducted based on the following conditions according to specific situations.
(1) Deduction for Criticism Notifications. (Article 5 assessed by the Municipal Urban Construction Supervision Detachment, others by the Urban Construction Department)
1. Each time the enterprise is criticized by the Ministry of Housing and Urban-Rural Development or the Jiangsu Provincial People's Government in market activities, 3 points will be deducted, valid for 24 months.
2. Each time the enterprise is criticized by the Jiangsu Provincial Department of Housing and Urban-Rural Development or the Changzhou Municipal People's Government in market activities, 2 points will be deducted.
3. Each time the enterprise is criticized by the Changzhou Municipal Urban-Rural Construction Bureau, the municipal (district) people's government, or the municipal (district) construction administrative department in market activities, 2 points will be deducted.
4. For violations of documents or notification requirements by construction administrative departments at all levels or their entrusted supervision departments in market activities, 1 point will be deducted for each item.
5. Each time the enterprise receives an administrative penalty in market activities, 3 points will be deducted.
(2) Deduction for Quality and Safety Accidents Occurring within Changzhou City (assessed by the Municipal Construction Management Center)
1. For major or above quality and safety accidents in projects undertaken by municipal enterprises, 10 points will be deducted for each incident, valid for 24 months.
2. For relatively large quality and safety accidents in projects undertaken by municipal enterprises, 6 points will be deducted for each incident.
3. For general quality and safety accidents in projects undertaken by municipal enterprises, 3 points will be deducted for each incident.
4. For concealment, false reporting, or delayed reporting of quality and safety accidents in projects undertaken by municipal enterprises, 5 points will be deducted for each incident.
(3) For municipal enterprises with adverse records recognized by the Discipline Inspection Commission and judicial departments during construction activities, 3 points will be deducted for each incident. (assessed by the Urban Construction Department)
For municipal enterprises recognized by judicial departments for bribery during construction activities, in addition to handling according to relevant provisions of the "Construction Law" and "Bidding Law," 5 points will be deducted for each incident.
2. In the market behavior assessment, deductions will be made based on specific situations when the following conditions are found. (assessed by the project construction unit)
1. Municipal enterprises that alter, forge, or lend business licenses, construction enterprise qualification certificates, safety production permits, seals, and personal qualification certificates, or provide false performance proofs or authorization materials, will be deducted 2 points per case.
2. Construction units that transfer all contracted projects to other units or individuals for construction will be deducted 2 points per case.
3. General contracting or specialized contracting units that disassemble all contracted projects and transfer them to other units or individuals under the name of subcontracting will be deducted 2 points per case.
4. Construction units that subcontract projects to individuals or units without the corresponding qualifications or safety production permits will be deducted 2 points per case.
5. General contracting or specialized contracting units that subcontract all contracted projects to labor service units, where the labor subcontracting unit charges the entire project payment except the "management fee" paid to the general or specialized contractor, will be deducted 2 points per case.
6. General contracting or specialized contracting units that directly or indirectly transfer all contracted projects to other units or individuals through cooperation, joint ventures, personal contracting, or other forms will be deducted 2 points per case.
7. General contracting enterprises that subcontract part of their contracted projects to other specialized units without the approval of the construction unit will be deducted 1 point per case.
8. Specialized subcontracting units that further subcontract the non-labor parts of their contracted specialized projects will be deducted 2 points per case.
9. Labor subcontracting units that further subcontract their contracted labor will be deducted 2 points per case.
10. Construction contracts (including specialized and labor subcontracting contracts) that have not completed filing (witnessing) procedures will be deducted 0.5 points per case.
11. Construction contracts that do not clearly specify the payment time, settlement method for project payments (including labor wages), or corresponding measures to ensure timely payment; labor subcontracting contracts that do not specify the labor responsible person will be deducted 0.5 points per case.
12. General contracting enterprises that fail to review the qualifications of subcontracting enterprises and report to supervision for approval or have incomplete approval procedures will be deducted 0.2 points per item.
13. Municipal enterprises that fail to timely handle the "Jiangsu Province Construction Enterprise Credit Management Manual" as required will be deducted 0.5 points per case.
14. General contracting (specialized contracting) enterprises that subcontract projects to subcontracting units without a credit management manual will be deducted 0.5 points per case.
15. Municipal enterprises that fail to handle credit information changes (qualification level and content changes, communication methods, personnel changes) within the prescribed time will be deducted 0.5 points per item.
16. Municipal enterprises that fail to establish or have incomplete payment ledgers for project payments (subcontract project payments) will be deducted 0.2 points per case.
17. Municipal enterprises that fail to establish or have incomplete ledgers for material and equipment procurement or leasing will be deducted 0.2 points per case.
18. General contracting (specialized contracting) enterprises that fail to pay subcontract project payments (including labor project payments) as per contract will be deducted 1 point per case.
19. Project departments that fail to promptly settle wages for workers leaving the site, or whose settlement sheets lack signatures of the involved workers and are not archived for reference, will be deducted 0.5 points per case.
20. General contracting (specialized contracting) construction enterprises that do not pay labor project payments to labor enterprises, or pay migrant workers' wages to contractors or team leaders instead of directly to the workers without a legal authorization letter, will be deducted 1 point per case.
21. If more than 10 migrant workers complain to the local construction administrative department and the construction enterprise does not cooperate or handles it poorly, 1 point will be deducted per case; if more than 10 migrant workers complain to the provincial construction administrative department or people's government at any level and the enterprise does not cooperate or handles it poorly, 1.5 points will be deducted per case.
22. Project site departments that do not post job responsibility systems will be deducted 0.2 points per item.
23. Municipal engineering project managers who simultaneously serve as project leaders on two or more projects in violation of regulations will be deducted 2 points per case.
24. Municipal enterprises whose registered constructors (project managers) specified in construction contracts do not perform their duties as required by the Ministry of Housing and Urban-Rural Development, with monthly attendance below 80%, will be deducted 1 point per case.
25. Main management personnel at the site project department who do not perform their duties as required will be deducted 0.1 points per person.
3. In the assessment of project bidding activities, the following situations will be deducted points according to specific circumstances. (Municipal Bidding Office assessment)
1. In bidding activities, if it is verified that bidders collude with each other or with the tenderer, or bidders bribe the tenderer, bidding agency, or evaluation committee members to win bids, 5 points will be deducted per item.
2. In municipal enterprise bidding activities, if different bidders' bidding documents (including electronic files) show abnormal consistency, identical errors or omissions, abnormal or regular changes in bidding prices or components, documents prepared by the same unit or person, identical project management team members, mixed documents, documents prepared or printed by the same computer or device, entrusted bidding by the same person, or use of the same person or company funds to pay bid bonds, 3 points will be deducted per item.
3. In municipal enterprise bidding activities, if bidders fail to submit performance bonds as required, qualified bidders do not purchase bidding documents or submit bids without valid reasons, abandon winning projects, fail to sign contracts after winning bids, impose additional conditions or change substantive contract content when signing, fail to file contracts timely after winning, or fail to submit bid difference guarantees as required, 1 point will be deducted per item.
4. In bidding activities, municipal enterprises found to have the following issues: key personnel arriving late at bid opening; the legal representative or registered constructor required by the bidding announcement or documents not present; relevant personnel not carrying valid second-generation ID cards or other valid identification; bid letters in the bidding documents not stamped with the bidder's official seal and legal representative's seal; bidder's name or organizational structure inconsistent with prequalification; registered constructor inconsistent with prequalification; the project completion deadline stated in the bid documents exceeding the deadline specified in the bidding documents; bid price exceeding the maximum limit specified in the bidding documents; bid documents lacking a joint bidding agreement from all consortium parties; legal representative's agent lacking a valid original power of attorney and agent's seal. For every three cumulative occurrences within six months, 1 point will be deducted.
5. Municipal enterprises found to falsify or manipulate prices in project cost valuation activities will be deducted 1 point for each item (instance).
6. For maliciously low and extremely unbalanced bid prices, specific point deductions are detailed in Table 2; the same bidding unit can be deducted a maximum of 3 points within one month.
4. In the engineering quality supervision and management assessment, the following situations will result in point deductions based on specific circumstances. (Article 6 is assessed by the project construction unit; others by the Municipal Construction Management Center).
1. Construction not carried out according to construction drawings approved by the construction drawing review agency or construction technical standards will result in a deduction of 1 point per item; incomplete design change procedures will result in a deduction of 0.5 points per item.
2. Violations of mandatory provisions of engineering construction standards during construction will result in a deduction of 1 point per item; violations of mandatory standards will result in a deduction of 0.5 points per item.
3. During construction, if the project manager fails to regularly organize quality hazard inspections and timely eliminate quality and safety hazards; fails to organize acceptance of concealed works; or is ordered to partially stop work due to serious quality hazards, 1.5 points will be deducted each time.
4. If the project manager does not participate in the acceptance of main structure and other sub-projects, does not participate in unit project and project completion acceptance; or does not sign or signs false documents on acceptance files, 0.5 points will be deducted per item.
5. After project completion acceptance, failure to fulfill warranty obligations, delay in fulfilling warranty obligations, or if the local quality supervision agency receives more than two quality complaints about the project and investigation confirms it is a construction unit quality issue, 1 point will be deducted; if group petitions confirm construction unit quality issues, 1.5 points will be deducted.
6. For municipal public works during the warranty period, the following serious issues caused by construction quality will result in deductions:
① Significant damage, settlement, tilting, or surface peeling of sidewalks and curbstones will result in a deduction of 0.3 points.
② Longitudinal cracks in asphalt surface will result in a deduction of 0.1 points per occurrence; asphalt pavement settlement, damage, obvious rutting, and bulging will result in a deduction of 0.1 points per occurrence; pavement settlement, longitudinal offsets, and cracks along pipeline axis will result in a deduction of 0.3 points.
③ Settlement of road range inspection wells and asphalt damage around wells will result in a deduction of 0.1 points per occurrence.
④ Significant settlement behind bridge abutments and bridge head bumps affecting driving comfort will result in a deduction of 0.3 points.
⑤ Leakage in pipelines, wells (pools), and structures will result in a deduction of 0.5 points per occurrence.
5. In construction safety supervision and management assessment, the following situations will result in point deductions based on specific circumstances. (Assessed by the Municipal Construction Management Center).
1. Municipal enterprises lowering safety production conditions, failing to establish and effectively implement safety production systems, failing to fulfill safety production responsibilities at all levels, failing to sign safety production responsibility agreements and conduct safety production target assessments as required, or failing to set up safety management organizations and assign full-time safety management personnel as required, will be deducted 0.5 points per item (instance), valid for 6 months.
2. Municipal enterprises and construction site project departments failing to implement effective safety management, violating mandatory provisions of engineering construction standards, or having major safety hazards and being ordered to partially stop work for rectification, will be deducted 2 points each time, valid for 6 months.
3. Construction sites found using lifting machinery without proper registration or continuing to use after deregistration notification, will be deducted 1 point per machine, valid for 6 months.
4. During construction, refusal to comply with stop-work rectification orders issued by supervision units will result in a deduction of 1 point per occurrence; failure to complete rectification within the specified time after safety supervision agency orders will result in a deduction of 1 point per occurrence; falsification in rectification responses will result in a deduction of 2 points per occurrence, valid for 6 months.
5. Temporary facilities at construction sites not meeting fire protection design requirements for dormitories and office buildings according to the "Technical Specifications for Fire Safety at Construction Sites" will result in a deduction of 1 point per occurrence, valid for 6 months.
6. Municipal enterprises and construction site project departments failing to carry out various safety production activities and personnel safety education and training as required will be deducted 0.5 points, valid for 6 months.
7. For high-risk sub-projects, if the project leader is not present on site during construction and there is evidence of proxy signing in safety documents, 1 point will be deducted per item (instance), valid for 6 months.
 
6. In the civilized construction assessment, the following situations will result in point deductions based on specific circumstances. (Assessed by the project construction unit).
1. During construction, if poor management results in deductions by the digital urban management long-term system, 1 point will be deducted each time; if exposed by media (including newspapers, TV, internet, etc.), 2 points will be deducted per project per occurrence, valid for 6 months.
2. If complaints due to violations or rough construction at the construction site are verified, 0.5 points will be deducted per item per occurrence, valid for 6 months.
7. Except where otherwise specified, the validity period for the above deductions is 12 months.
Attachment 1.4
Daily Assessment Procedures for Municipal Enterprises
Article 1 To further strengthen the management of credit assessment information collection for municipal enterprises, ensure that information collection is lawful, scientific, open, fair, timely, and accurate, and promote coordinated supervision of market behavior of all construction parties and construction site behavior, these procedures are formulated based on the "Changzhou Municipal Enterprise Credit Assessment Implementation Rules (Trial)" (hereinafter referred to as "Rules").
Article 2 The Changzhou Urban and Rural Construction Bureau entrusts the bidding supervision, construction management center, administrative law enforcement, municipal project construction units, and other units to be responsible for the daily assessment work of municipal enterprises.
Article 3 Each unit shall establish relevant systems for the daily assessment work of municipal enterprises, clarify work responsibilities and authorities, assign specific responsible persons, and implement management according to work procedures.
Article 4 The daily assessment of municipal enterprises shall be conducted according to the following procedures.
1. Each assessment unit, in accordance with the provisions of the "Regulations," when discovering that municipal enterprises have violated the "Regulations" and implementing point deductions, shall record the specific violations of the enterprise into the "Changzhou Construction Market Supervision Management System" and submit it to the main leader of the unit for review;
2. After the main leader of the unit reviews the point deduction suggestions proposed by the on-site supervision personnel, if it is determined that the point deduction must be implemented, the review shall be approved in the "Changzhou Construction Market Supervision Management System" and submitted to the Municipal Construction Bureau for further review;
3. After approval by the bureau's responsible leader, the point deduction shall be entered into the "Changzhou Construction Market Supervision Management System" municipal enterprise credit assessment subsystem.
Article 5: If the enterprise being deducted points disputes the deduction facts, it may appeal to the unit that proposed the daily assessment point deduction. The unit proposing the deduction shall earnestly perform the review duties. If the deduction facts are incorrect, correction shall be ordered; the review results shall be notified to the party involved.
